Johannesburg, South Africa – As reported in June 2015, the Competition Appeal Court upheld Sasol Chemical Industries’ appeal against the Competition Tribunal’s finding of excessive pricing in respect of propylene and polypropylene. The Competition Appeal Court concluded that the decision of the Tribunal was to be set aside and that Sasol’s prices during the period were not excessive.
On 23 July 2015 the Competition Commission served a notice on the Constitutional Court whereby the Competition Commission sought leave to appeal the decision of the Competition Appeal Court to the Constitutional Court.
This matter originates from the investigation initiated by the Competition Commission into the South African polymer industry in 2007, whereupon the matter was referred to the Tribunal in 2010.
On 17 November 2015, the Constitutional Court dismissed the Commission’s application for leave to appeal. Sasol welcomes the Constitutional Court’s decision, which will bring an end to this matter.
